1. Introduction and acceptance
Welcome to Holvex Pty Ltd trading as Hormn (ABN 32 688 453 858) ( Hormn , we , us , our ). Hormn operates a digital health platform that connects patients with independent healthcare practitioners, pharmacies, and pathology providers in Australia. These Terms and Conditions (“Terms”) govern your use of Hormn’s website, platform, and services. By creating an account, contacting us, booking a consultation, or otherwise using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not accept all of these Terms, you must not use the Hormn Platform or services.
2. Definitions
In these Terms:
- “Platform” refers to Hormn’s websites, mobile applications, and other digital platforms through which we provide our services.
- “Services” refers to all services provided by Hormn via the Platform, including facilitating telehealth consultations (“Consultations”) with healthcare practitioners, prescription processing, medication delivery coordination, pathology test coordination, and related customer support.
- “Healthcare Practitioner” or “Practitioner” means an independent registered medical practitioner (e.g. a doctor) who provides consultations to users through the Platform. Practitioners are not employees of Hormn; they act as independent contractors who exercise their own medical judgment.
- “Pharmacy” means an independent Australian registered pharmacy (or pharmacies) partnered with Hormn to dispense medications prescribed to you. Hormn itself is not a pharmacy and does not dispense, store, or supply medications.
- “ScriptMate” means ScriptMate Pty Ltd, an independent service provider engaged by Hormn to process prescriptions and payments on behalf of partner Pharmacies. ScriptMate facilitates forwarding your prescription to a Pharmacy and arranging medication delivery.
- “Pathology Provider” refers to third-party pathology services (such as Healius Pathology) that conduct laboratory tests at the request of your Practitioner.
- “You” or “User” means the person who creates an account on the Platform and/or uses the Services.
Other capitalized terms may be defined elsewhere in these Terms. Headings are for convenience only and do not affect interpretation.
3. Hormn’s services and platform role
Hormn provides an online platform to facilitate your access to telehealth consultations and related services for men’s health and wellness. Hormn’s role is limited to connecting you with independent medical practitioners, arranging for pathology tests, and coordinating the processing of any prescriptions through partner pharmacies. Hormn is not a provider of medical care itself; all medical advice, diagnosis, prescriptions, or treatment plans are given by Healthcare Practitioners in their independent professional capacity. Hormn does not practice medicine or pharmacy – we do not dispense or stock any medications ourselves.
Hormn helps organize the logistics of your care, including referral for lab tests and facilitating prescription fulfillment with Australian pharmacies. Any information on our Platform or website that is not part of a direct consultation (such as general health articles or FAQs) is for general informational purposes only and is not medical advice. The Platform and Services are not intended for use in medical emergencies or urgent situations – if you require urgent or emergency care, call 000 or seek immediate in-person medical attention. We may, if concerned about your or someone else’s immediate welfare during a consultation, contact emergency services as appropriate.
You acknowledge that only a qualified medical practitioner can determine if a particular treatment (such as testosterone replacement therapy, weight management medication, or erectile dysfunction treatment) is appropriate for you. Hormn cannot guarantee that you will receive any specific medication or outcome from using our Services. Issuing any prescription is at the sole discretion of the consulting Practitioner, who will only prescribe if they find it clinically appropriate and lawful to do so. Hormn does not endorse or guarantee any particular Practitioner, medication, or treatment – all such decisions are made by you and the Practitioner based on your consultation.
4. User eligibility and account registration
Eligibility: Our Services are intended for Australian adult residents. By registering and using the Platform, you represent and warrant that you are at least 18 years old, currently residing in Australia with a valid Australian address, and are using Hormn for your own personal healthcare (and not on behalf of another person unless you have legal authority to do so). You also confirm that you have the legal capacity to enter into this agreement and will only use the Services in compliance with these Terms and applicable laws. If any of these eligibility criteria cease to be true (for example, if you move overseas or allow someone else to use your account improperly), you must stop using the Services, and Hormn reserves the right to suspend or terminate your account.
Account Registration: To access consultations and services, you must create a user account on the Platform. You agree to provide accurate, current, and complete information during registration and at other times as requested, including your full name, date of birth, contact details, and any medical or payment information needed. All information you provide must be truthful and not misleading. You must update your information if it changes, so that records remain accurate at all times. If you provide false, outdated, or incomplete information, or if we have reason to suspect such, we may suspend or terminate your account and you may be unable to use the Services. You are responsible for any consequences (including risks to your health) that result from your failure to provide full and accurate information.
Account Security: Upon registration, you will create login credentials (such as a username and password). You are responsible for maintaining the confidentiality and security of your account credentials. Do not share your login information with anyone. You must notify Hormn immediately if you suspect any unauthorized access to or use of your account or any breach of security. You must also ensure that you log out and secure your account when not in use, especially if using a shared device. Hormn is not liable for any loss or damage arising from your failure to protect your account credentials.
5. Appointments and consultations
Booking Consultations: The Platform enables you to book telehealth consultations with Healthcare Practitioners licensed in Australia. Consultations may be conducted via phone, video call, or secure messaging, as made available. When you book an appointment, you agree to pay any applicable consultation fee (if any, see Fees section) and attend the consultation at the scheduled time. Hormn does not guarantee that a particular Practitioner will be available at any given time, but we will use reasonable efforts to accommodate your scheduling preferences. We reserve the right to refuse or cancel a consultation booking, or to discontinue Services to you entirely, at any time and for any reason (for example, if you violate these Terms or if we determine our Services are not suitable for your needs). We may also reschedule a consultation if necessary (e.g., due to Practitioner availability or technical issues), and will inform you as soon as possible if a reschedule is needed.
During Consultation: You agree to actively participate in your Telehealth consultation and provide thorough and honest information about your health, symptoms, medical history, and lifestyle as requested by the Practitioner. The scope of the consultation is limited by the nature of telehealth; Practitioners will rely on the information you provide and may not be able to perform physical examinations. You understand that a Practitioner may determine that your condition is not suitable for diagnosis or treatment via telehealth alone, and they may direct you to seek in-person medical care or additional tests. The Practitioner may also require you to undergo certain pathology tests (e.g. blood tests) or provide prior medical records before confirming a diagnosis or treatment plan. If you are deemed suitable for treatment through Hormn, the Practitioner will discuss a proposed treatment plan with you, which may include prescribing medication or ordering further investigations. If the Practitioner finds that Hormn’s services are not appropriate for you, no prescription will be issued and you will be advised to seek alternative care; any fees already paid for that consultation will not be refunded unless required by law or as outlined in Section 8.
Medical Advice and Follow-Up: Any medical advice, diagnosis, or treatment you receive through the Platform is provided solely by the Practitioner, based on their professional judgment and the information you have given. You acknowledge that the Practitioner is responsible for your care during the consultation, and that Hormn is not providing medical advice or treatment. It is your responsibility to follow the medical advice or treatment plan given to you, including taking medications as prescribed and completing any recommended tests or follow-up appointments. You should also continue any routine health care or specialist consultations outside of Hormn as needed; our telehealth Services are not a substitute for all aspects of your healthcare, and we encourage you to keep your regular GP or healthcare providers informed about treatments you receive through Hormn. If you experience any adverse or unexpected effects from a medication or treatment provided via Hormn, you must promptly inform the Practitioner or Hormn’s clinical support team, and seek emergency care if the reaction is serious. Do not delay or disregard medical advice from your in-person doctors or emergency providers based on anything from your use of our Platform.
No Guarantees: You understand that health outcomes cannot be guaranteed. Hormn and the Practitioners do not promise any particular result or cure from your treatment. The Practitioner’s prescription of any medication is subject to their clinical judgment, and they may choose not to prescribe any medication if it is not medically appropriate or safe in their opinion. Being deemed eligible for a consultation or completing a questionnaire on the Platform does not guarantee you will receive a prescription or service; all treatments are provided case-by-case at the Practitioner’s discretion.
6. Prescriptions and pharmacy services
Prescription Processing: If, following your consultation, a Practitioner issues a prescription for you, you agree that Hormn (through ScriptMate and our Platform) will facilitate the fulfillment of that prescription. You authorise Hormn and ScriptMate to share your prescription and relevant personal information (such as your name, address, contact info, and any necessary medical details) with a partner Pharmacy and any logistics or delivery partners, as needed to process your medication order and have it delivered to you. We will only share information reasonably required to enable the Pharmacy to dispense and supply your medication to you.
Pharmacy Fulfillment: The medication prescribed to you will be dispensed by a licensed Pharmacy in our network. The Pharmacy will receive your electronic prescription (or a copy thereof) and will review it before dispensing, subject to all legal requirements (for example, the Pharmacy or pharmacist may verify the prescription’s validity and may refuse to dispense if there are concerns or if it contravenes any law or professional obligation). The Pharmacy will then package and arrange delivery of the medication to the address you provided, via courier or postal service. You agree that ownership of the medication passes to you when it is dispensed and paid for at the Pharmacy; any delivery service is provided as an agent of the Pharmacy to you. ScriptMate Payment Processing: Payment for your prescribed medication is facilitated through ScriptMate. When a prescription is issued, you will be charged the cost of the medication (including any applicable dispensing fees, shipping costs, and GST) via the payment method you have provided. This charge may be processed by ScriptMate on behalf of the Pharmacy. By accepting these Terms, you authorise such charges and agree to pay for any medication that a Practitioner prescribes and you choose to have fulfilled through our partnered Pharmacy. If your payment fails or is declined, the medication will not be dispensed or shipped, and we will notify you to arrange an alternative payment.
Medication Delivery: Hormn and ScriptMate will work with the Pharmacy to have your medication delivered to you promptly. While we strive for timely delivery, we do not guarantee specific delivery times and are not responsible for delays or losses caused by third-party courier services or events outside our control. Once the Pharmacy dispatches the medication, you will receive a notification (e.g., email or in-app) with delivery details. It is your responsibility to ensure someone is available to receive the delivery, if required (for example, some medicines may require a signature on delivery). The risk of loss or damage to medications passes to you upon delivery.
Your Responsibilities for Medication: Any prescription medication you receive via the Platform is for your personal use only. You must use the medication strictly as directed by the prescribing Practitioner and in accordance with any instructions on the label. You must not share your prescription medication with any other person, even if they have similar symptoms or conditions. You agree to store medications safely and not to use them past their expiry date. If you have any questions about dosage or experience side effects, you will promptly contact a healthcare professional. Misuse of prescription medication is dangerous and may also be illegal. Hormn and the Pharmacy reserve the right to refuse to provide further Services to you if we suspect misuse or diversion of medications.
Alternate Pharmacy Option: You are not obligated to use our partner Pharmacy. If you prefer to have your prescription filled by a pharmacy of your choice, you may request that we send your prescription to a different pharmacy. Such a request must be made in writing as soon as possible after the prescription is issued. We will endeavour to transfer the prescription to your nominated pharmacy within a reasonable time, provided it is lawful to do so and the prescription has not already been dispensed by our partner Pharmacy Please note that if you choose an alternate pharmacy, you will be responsible for arranging payment and delivery with that pharmacy, and certain subscription or delivery services offered through Hormn may not apply.
No Returns on Medications: By law, pharmacies cannot accept returns of prescription medication once it has been dispensed, except in very limited circumstances (such as a recall). Therefore, all sales of prescription medications are final. If you cancel your order or subscription after your medication has been dispensed by the Pharmacy, you will still be charged for that medication and no refund will be available (except where required by law or as set out in Section 9). In the unlikely event that the medication you receive is incorrect, defective, or damaged upon delivery, please contact us or the Pharmacy immediately so that we can review the issue. If the problem was due to our or the Pharmacy’s error, we will work with you to provide an appropriate remedy (such as a replacement or refund in accordance with applicable law).
7. Pathology services
As part of our Services, your Practitioner may determine that you require pathology tests (for example, blood tests to check hormone levels or other health indicators). Hormn partners with independent pathology providers (such as Healius Pathology) to facilitate these tests. If pathology testing is required:
- Test Orders: The platform will either provide you with a pathology request form or send an electronic order to the Pathology Provider. Hormn will coordinate this process, and you will be given instructions on how to complete the test (e.g., visiting a local collection center or using a provided kit). You may need to present identification at the pathology collection point as required by the Pathology Provider.
- Consent to Share Information: By agreeing to undergo pathology tests through our Services, you authorise Hormn to share your necessary personal information (such as your full name, date of birth, contact details, and relevant clinical information) with the Pathology Provider to the extent needed to perform the tests and accurately identify your samples. You also consent to the Pathology Provider disclosing your test results to the Practitioner and Hormn. We will receive your results and incorporate them into your medical record on the Platform, and your Practitioner will review them with you. Hormn will treat your test results confidentially in accordance with our Privacy Policy (see Section 11).
- Fees for Tests: Pathology fees (if any) may be charged by the Pathology Provider. Hormn may collect the pathology fee on behalf of the Pathology Provider.
- No Warranty on Pathology Services: The actual pathology testing is conducted by the independent Pathology Provider, not by Hormn or the Practitioner. While we facilitate the referral, we have no control over and make no warranties regarding the services of the Pathology Provider. Hormn is not liable for any errors, omissions, or delays in the testing process or results, except to the extent required by law. However, if you believe there has been an error with your test (such as a sample mix-up or lost result), please notify us and we will assist you in communicating with the Pathology Provider to resolve the issue.
- Follow-Up: Once your results are available, Hormn or your Practitioner will notify you and may schedule a follow-up consultation to discuss the findings. It is your responsibility to attend any recommended follow-up and to adhere to any advice given based on your results. If you choose not to complete recommended tests or not to share results with us, the Practitioner may be unable to provide or continue treatment for you, and Hormn may decline to provide further Services in such cases.
8. Fees and payment
Consultation Fees: You agree to pay all fees associated with the Services that you utilize, as informed to you at the time of booking or purchase. Hormn will disclose consultation fees (if applicable) before you confirm an appointment with a Practitioner. Fees may vary depending on the type of consultation or program. Some consultations (for example, initial screening consultations) might be offered at no charge or at a promotional rate, at Hormn’s discretion. Unless otherwise stated, all fees are quoted in Australian dollars and include Goods and Services Tax (GST). You must pay the fee in full at the time of booking the consultation (or at the time of ordering a service) in order to secure your appointment or service. If your payment is not received or is declined, your appointment may be canceled.
Medication and Subscription Fees: Fees for medications prescribed (and any ongoing subscription program fees) will be charged as described in Section 6 and Section 9. Medication prices will be communicated to you prior to charging and dispensing. In a subscription model, the price per billing period will be made clear to you when you enroll, and again prior to each renewal (see Section 9). Note that initial consultation fees (for the Practitioner’s time) are separate from medication costs and subscription; consultation fees cover the telehealth assessment and are payable regardless of whether a prescription is issued. Medication fees cover the cost of the medication itself and pharmacy dispensing/delivery, payable if and when you choose to have a prescription filled. Our fees do not include any third-party costs that you may incur outside our Platform, such as pathology tests (as described above) or products/services you obtain from others.
Payment Methods: We accept payment via credit card, debit card, or other payment methods as enabled on the Platform. By providing a payment method, you represent that you are authorised to use that method and you authorise Hormn (or our payment processor, including ScriptMate or other third-party) to charge the full amount of the fees to that payment method. We may securely store your payment details for the purpose of billing recurring subscription charges or future orders, in accordance with our Privacy Policy. If your payment method expires or is declined, you agree to provide a new eligible payment method promptly. You are responsible for any bank or card fees that may arise from our charges (for example, international transaction fees if applicable).
Refunds and Credits: Except as expressly provided in these Terms or as required by law, all fees are non-cancellable and non-refundable. This means that once a consultation has occurred or a service has been provided, you are not entitled to a refund of the fees if you change your mind or are dissatisfied with the outcome. In particular, if a Practitioner determines that you are not a suitable candidate for treatment through Hormn after a consultation, the consultation fee remains payable for the Practitioner’s time and expertise (however, see below regarding our discretion for first-time users). Likewise, if you are not satisfied with your treatment, medication, or results, that is not by itself a ground for refund. We will, of course, provide a refund or remedy where required under the Australian Consumer Law or other applicable laws (for example, if a service we provided was not delivered with due care or was otherwise deficient under a consumer guarantee). We may also offer refunds or credits in specific situations at our discretion as a courtesy or customer service gesture, but this does not waive our rights under these Terms.
If Hormn must cancel a consultation you have paid for (for example, due to Practitioner unavailability) and we cannot reschedule you within a reasonable time, we will refund the consultation fee in full. If you have been charged for a service or product that was not provided due to an error on our part, we will refund or not charge you for that item. Any approved refunds will be processed to the original payment method wherever possible and within a reasonable timefram
9. Subscription terms and cancellation
Hormn may offer certain treatment plans or medication plans on a subscription basis (for example, monthly refills of medication or ongoing care programs). If you enroll in a subscription or recurring service, the following terms apply:
Automatic Renewal: By subscribing, you agree that your subscription will automatically renew at the interval disclosed (e.g. monthly) and that you will be charged the applicable subscription fees (which may include medication cost, delivery, and any service fee) at each renewal until you cancel. Each subscription period constitutes a new contract under these Terms on the same terms, unless updated Terms or prices are communicated to you prior to renewal. Your payment method on file will be billed automatically at the start of each subscription period (for example, on the same day each month). We may provide you with a reminder or notice before processing each renewal payment, which may include details of the upcoming charge and any changes to the subscription (such as price changes or updates to these Terms). However, the absence of a reminder does not waive your responsibility to manage your subscriptions.
Changes in Fees: Subscription fees may be adjusted by Hormn from time to time (for instance, if medication costs change or we modify program pricing). If the subscription fee or structure is due to change, we will give you advance notice of the new fee that will apply upon your next renewal. If you do not agree to a fee change, you must cancel the subscription before the new fee comes into effect. Continuing the subscription without cancellation will constitute acceptance of the new fees.
Cancellation by You: You may cancel your subscription at any time for any reason by providing notice to Hormn (for example, by emailing our support at the address in Section 18, or using any cancellation function provided in your account settings). To avoid being charged for the next shipment or period, you should cancel at least 3 days before your next billing date (if possible, we recommend a minimum of 3 business days prior) so that we have time to process your request. If you cancel a subscription, you will continue to receive the products/services that you have already paid for up to the end of the current subscription period, but the subscription will not renew thereafter. We do not offer pro-rated refunds for the remaining days in a subscription period if you cancel after a charge has been processed, except at our discretion or if required by law. For example, if you cancel after your monthly payment has been charged and the pharmacy has already dispensed that month’s medication, you will receive that medication and the subscription will terminate the following month.In some cases, if you submit a cancellation request very close to your renewal date and the request is not processed until after your payment was collected, we may choose to refund that last charge and not send the corresponding medication, provided the medication has not yet been dispensed or shipped. This is evaluated on a case-by-case basis and is not guaranteed. Prescription medications that have been dispensed prior to your cancellation request cannot be refunded (see “No Returns on Medications” in Section 6).
Cancellation by Us: We reserve the right to cancel or suspend your subscription at our discretion. We may do so, for example, if a medication is withdrawn or unavailable, if you no longer meet eligibility or prescribing criteria for the treatment, or if you violate these Terms. We will give you reasonable notice of such cancellation where practicable. If Hormn cancels your subscription for reasons other than your breach of terms or safety/eligibility concerns, and you have already been charged for a period that has not yet fully elapsed, we will provide a pro-rata refund for the unused portion of that period. If cancellation is due to your breach or a concern for safety/appropriateness (e.g., misuse of service or medical reasons to stop therapy), we may cancel with immediate effect and no refund for that period, but we will not charge further renewal fees.
Membership Programs: If Hormn offers any membership or program that includes a recurring fee (apart from medication shipments), similar terms will apply. You can cancel membership renewals at any time effective from the next billing cycle. Membership benefits and access will continue until the end of the paid period and then terminate.
Your Consumer Rights: Nothing in this Section 9 (or elsewhere in these Terms) is intended to exclude or restrict your rights under Australian consumer laws. You have certain rights to cancel or obtain refunds in particular circumstances, such as for major failures of a service or product. Those statutory rights apply in addition to our cancellation policy.
10. User obligations and acceptable use
By accessing the Hormn Platform and using our Services, you agree to the following obligations:
Provide Information and Cooperation: You must provide complete, truthful, and up-to-date information whenever requested, including during the health questionnaire, consultation, and any follow-ups. This includes disclosing your medical history, current medications, allergies, and other relevant health information. Failing to provide information or providing false/misleading information can lead to improper care and is a breach of these Terms. You agree to cooperate with Practitioners and follow their reasonable instructions (for example, to get blood tests or to provide feedback on your treatment). You are responsible for any consequences resulting from omitted or incorrect information you supply (Hormn and the Practitioners rely on you to be honest and thorough).
Personal Use Only: You agree to use the Platform and Services only for your personal healthcare needs (or for someone under your care if explicitly allowed and arranged, such as if you are an authorised caregiver – in which case, you must provide proof of legal authority). You must not create accounts for anyone other than yourself, or impersonate any person or entity. You must not allow any other person to use your Hormn account, and you will not use the Services to seek medication or treatment for another individual under your own name. If you need another person (such as a family member) to assist you in using our Services or communicating (an “Authorised Representative”), please contact us to arrange appropriate consent and documentation. You will be responsible for the actions of anyone you authorise to access your account or information.
Lawful and Appropriate Use: You agree to use the Platform and Services only for lawful purposes and in accordance with these Terms. You must not engage in any fraudulent, illegal, or abusive activity in relation to our Services. This includes, without limitation:
- Prohibited Conduct: You will not seek to obtain prescriptions for prohibited or non-therapeutic uses. You will not falsify or misrepresent your health information or identity. You will not attempt to obtain medications to which you are not entitled, or in greater quantities than prescribed. You will not resell or distribute any medication obtained through Hormn.
- Respectful Communication: You will treat all Hormn staff, Practitioners, pharmacy personnel, and any support staff with courtesy and respect. Harassment, abuse, or use of offensive/threatening language towards healthcare providers, customer support, or any personnel is strictly prohibited. Hormn reserves the right to terminate your access for abusive behavior.
- No Unlawful Content: You must not transmit or share via the Platform any content that is defamatory, obscene, offensive, or otherwise unlawful, or any content that infringes on the rights of others.
- Technical Restrictions: You will not attempt to harm or interfere with the Platform. This means you must not introduce viruses or malicious code, attempt to hack or gain unauthorised access to our systems or data, perform any form of network monitoring or scraping of data, or overload the Platform (e.g., via a denial-of-service attack). Any such attempts may be reported to law enforcement and result in immediate termination of access.
- No Commercial Use: You must not use the Platform for commercial purposes or competitive research. This means you cannot use any content or information on our Platform for building a competing product or service, soliciting our users, or any form of data mining for competitive advantage. Our Platform and content are for personal healthcare use between you and Hormn.
Compliance with Laws: You agree to comply with all applicable laws and regulations when using our Services. This includes laws regarding the use of telehealth services, prescription medications, and privacy. If you are provided a prescription, you must observe all laws related to prescription medicine use and possession. If your use of the Platform or any Service is found to violate any law (for example, if you provide false information to obtain a controlled substance), Hormn may report such violations to the appropriate authorities and terminate your account.
Consequences of Misuse: If you violate any of the above obligations or any other provision of these Terms, Hormn may immediately suspend or terminate your account (see Section 15) and/or take legal action if appropriate. You may also be held responsible for losses or expenses incurred by Hormn as a result of your breach (see Indemnity , Section 14).
11. Privacy and data use
Your privacy is very important to us. Our Privacy Policy (available on our website) explains how we collect, use, store, and disclose your personal information, including any health information you provide. The Privacy Policy is incorporated into these Terms by reference, and by accepting these Terms you also accept the terms of the Privacy Policy.
In using our Services, you will provide us with sensitive personal information (such as health and medical information). You consent to Hormn collecting and handling this information for the purposes of providing you the Services and as otherwise described in our Privacy Policy. This includes processing your information to facilitate consultations, to share necessary details with Practitioners, pharmacies, ScriptMate, pathology providers and other partners as outlined in these Terms, and to improve our services. We will keep your personal information confidential and will not disclose it to third parties without your consent, except as required to deliver our Services or as required by law. For example, we will share your information with the Practitioner who consults with you, with the pharmacy that is dispensing your prescription, or with the pathology lab processing your test, as needed. We may also use de-identified information for analytics or regulatory reporting as detailed in the Privacy Policy.
Hormn implements industry-standard security measures to protect your data. However, you acknowledge that no system is completely secure and we cannot guarantee absolute security of information, especially in transmission. By using the Platform, you agree that we may communicate with you electronically regarding your account and health matters (for instance, sending appointment reminders, prescription updates, or lab results via the Platform, email, or SMS). We will obtain your consent where required for certain communications (such as including you in any marketing communications, which you can opt out of).

12. Intellectual property
All content, information, and materials made available on the Platform or through the Services – including text, graphics, logos, button icons, images, audio clips, software, and design elements – are the property of Hormn or its licensors and are protected by copyright, trademark, and other intellectual property laws. Hormn retains all rights, title, and interest in the Platform and its content. This includes the “Hormn” name, logo, and all related product and service names, which are trademarks of Hormn and may not be used by you without our prior written permission.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Platform and its content for your personal, non-commercial use in accordance with these Terms. Any unauthorized use of the Platform or its content is strictly prohibited. In particular, you must not: copy, reproduce, modify, distribute, transmit, display, perform, or create derivative works from any part of the Platform or content without our express permission; nor will you attempt to reverse engineer or extract the source code of any software on the Platform. You may not remove or alter any copyright, trademark, or other proprietary notices on any content accessed through the Platform.
If you submit any feedback, suggestions, or ideas regarding Hormn or the Services, you agree that we are free to use and implement those ideas without any compensation to you, and you assign any intellectual property rights in such feedback to us.
Your obligations regarding intellectual property survive termination of these Terms. If you print, copy, or download any content from the Platform in breach of these Terms, your right to use the Platform will cease immediately and you must return or destroy any copies of the materials you have made, as we direct.
13. Disclaimers and limitation of liability
No Warranties: To the fullest extent permitted by law, Hormn provides the Platform and Services on an “as is” and “as available” basis, without any warranties, guarantees, or conditions of any kind, either express or implied. While we strive to provide a high-quality service, we do not warrant that the Platform will be uninterrupted, error-free, or secure at all times. We do not guarantee that any results or outcomes can be achieved through our Services, or that the advice of the Practitioners will meet your expectations or requirements. Hormn makes no warranties regarding the completeness, accuracy, or timeliness of any information on the Platform (including information provided by third parties). Any health or medical information on our website that is not part of a personal consultation is for general knowledge and is not a substitute for professional medical advice, diagnosis, or treatment. Use of our Services is at your own risk.
Third-Party Services: Hormn relies on independent third parties to deliver critical components of our Services – including Practitioners, Pharmacies, ScriptMate, pathology labs, and couriers. We do not control these third parties and thus we disclaim liability for the acts or omissions of any third-party service providers, except as required by law. Specifically, we are not responsible for any negligence, misconduct, or breach of duty by a Practitioner or Pharmacy providing services to you, or for any errors by a pathology lab or shipping carrier. We do not guarantee the availability of any particular Practitioner or Pharmacy. While we have agreements in place with some partners (e.g., to maintain service standards), those partners are ultimately independent and not under our employment or direct control.
Limitation of Liability: To the extent permitted by law, Hormn (including our officers, directors, employees, contractors, and agents) will not be liable to you for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profit, goodwill, data, or opportunity, even if we have been advised of the possibility of such damages. This exclusion of liability applies to any claims arising out of or in connection with your use of (or inability to use) the Platform or Services, any information available through the Platform, or any conduct of Practitioners or third parties involved in the Services. Hormn’s total aggregate liability for all claims arising under or related to these Terms or your use of the Services shall be limited to the amount of fees actually paid by you to Hormn in the past six months (or, if greater, AUD $100), unless otherwise required by law.
In particular, and without limiting the above: Hormn is not liable for any injury, loss, or damage arising from the medical care (or lack thereof) you receive from a Practitioner, or from any medications prescribed (including side effects or reactions), or from any pathology testing or results, or from Pharmacy fulfillment and delivery issues. The Practitioners providing telehealth consultations are responsible for your treatment and owe you a professional duty of care; any legal claims related to medical negligence or malpractice should be directed to the Practitioner, not to Hormn. That said, if you have concerns about the quality of care or services, we encourage you to contact us so we can assist in resolving the issue.
No Liability for Inherent Risks: You acknowledge that any telehealth service has inherent limitations compared to in-person care, and Hormn is not liable for any diagnosis or decision that might have been different if you had seen a provider in person. You also acknowledge that all medications carry risks and benefits, and while Practitioners will explain these to you, Hormn is not liable for outcomes that are inherent risks of a treatment undertaken with your informed consent.
Non-Excludable Conditions: We do not exclude or limit any guarantees, warranties, or other rights that you have under Australian law that cannot lawfully be excluded or limited. This includes certain guarantees under the Australian Consumer Law (ACL) (for example, that services are rendered with due care and skill and goods are of acceptable quality). If a guarantee under the ACL is found to apply to our Services, and we breach it, your remedies will be as provided under the ACL. Where it is lawful to do so, and to the extent permitted by law, Hormn’s liability for breach of any non-excludable guarantee or condition is limited, at our option, to either supplying the service again or paying the cost of having the service supplied again (for services), or replacing the goods or paying the cost of replacement (for goods).
Release: You release and hold harmless Hormn and its affiliates from any claims, demands, and damages of every kind and nature arising out of or connected with any dispute between you and any Practitioner, Pharmacy, or other third-party provider (including any product or service they have supplied). This release does not apply to any liability that cannot be released by law.
14. Indemnity
You agree to indemnify, defend and hold harmless Hormn, its affiliated companies, and each of their respective directors, officers, employees, contractors, agents, and third-party service providers (each an Indemnified Party ) from and against any and all losses, liabilities, claims, demands, damages, costs, or expenses (including reasonable legal fees on a full indemnity basis) arising out of or in connection with: (a) your breach of any of these Terms or any warranty given by you herein; (b) any misuse of the Platform or Services by you, including any fraudulent, unlawful, or negligent acts or omissions; (c) any content or information you provide to Hormn (for example, if you provided false information that causes harm, or if content you provided infringes a third party’s intellectual property rights); (d) your violation of any applicable law or regulation in connection with your use of the Services; and (e) any claim made against us by a third party (such as a Practitioner or Pharmacy, or another user) due to your actions, information, or misuse of the Platform.
We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (at your expense), and you agree to cooperate with our defense of such claim. You must not settle any such claim without our prior written consent. This indemnity obligation will survive termination of your relationship with Hormn and the use of Services.
15. Termination and suspension
By User: You may terminate your use of the Platform at any time by closing your account or by notifying us that you wish to discontinue Services. If you choose to deactivate your account, we will cease charging you for any subscriptions after the then-current billing period (assuming you followed the cancellation process in Section 9 for any subscriptions). However, even after termination, certain provisions of these Terms will remain in effect (such as those relating to intellectual property, liability, and any outstanding payments).
By Hormn: We may suspend or terminate your account or access to Services (in whole or in part) at our sole discretion for any reason, including if you have violated these Terms or if in our judgment you have engaged in conduct that is harmful, unlawful, or could create liability for us or others. We may also suspend Services to you if we believe it is necessary to protect your safety (for example, if a medical issue arises that we cannot adequately manage via telehealth, we might pause services and refer you to in-person care). In most cases of non-emergency termination, we will provide notice to you (such as an email) of our decision to terminate or suspend, but we are not required to do so if the termination is due to your breach or unlawful behavior. During a suspension, you will not be able to use some or all of the Platform services (for example, you may not be able to book new appointments or get refills). If we terminate your account, your right to use the Platform ceases immediately.
If your account is terminated (by you or by us), you remain responsible for any outstanding obligations (e.g. unpaid fees) incurred before termination. We also reserve the right to cancel any pending consultations or medication orders at the time of termination. If we terminate your account due to a breach of these Terms or misuse, you will not be entitled to any refunds for services already provided or charges already incurred. If we terminate for convenience (not due to your fault) and you have paid for services not yet rendered, we will refund those amounts.
Post-Termination Data: Upon termination, we may disable your account and you may lose access to content or data associated with your account (except that which we are required to retain by law). Hormn will retain your medical records and personal information for the period required by law for healthcare records and in accordance with our Privacy Policy. If you wish to obtain a copy of your health records, you may contact us to request this. We may charge a reasonable administrative fee for providing copies of records, as permitted by law.
Survival: Any provisions of these Terms which by their nature should survive termination (such as indemnity, limitation of liability, dispute resolution, and intellectual property provisions) will remain in effect after termination.
16. Changes to terms
Hormn may update or modify these Terms from time to time. If we make material changes, we will post the revised Terms on our Platform and update the “Last Updated” date at the top, or otherwise notify you (for example, via email or a notification on your account). All amendments are effective from the date they are published on the Platform (or the date of notice, if given) unless a later date is specified. By continuing to use the Services or the Platform after the Terms have been updated, you are agreeing to the revised Terms. If you do not agree with a change, you must stop using the Platform and may terminate your account as described above.
These Terms (and any revised version) constitute the entire agreement between you and Hormn regarding the Services and supersede any prior agreements or understandings on the same subject matter. We encourage you to review the Terms periodically to ensure you understand the conditions of your use.
17. Governinglaw and dispute resolution
These Terms and your use of the Services are governed by the laws of Australia and, in particular, the laws in force in the State of New South Wales, Australia (without giving effect to any conflict of law principles). You agree that any dispute or claim arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts of New South Wales. You irrevocably submit to the jurisdiction of those courts for any such dispute.
Before initiating any legal claim, we strongly encourage you to contact us to discuss the issue. Many concerns can be resolved through our customer support or clinical team. We aim to address complaints in good faith and as efficiently as possible. If a dispute arises that cannot be resolved informally, you and Hormn may mutually consider alternative dispute resolution options (such as mediation or arbitration), but neither party is obligated to agree to such procedures under these Terms.
Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision will be deemed severed from the Terms and will not affect the validity and enforceability of the remaining provisions. The remaining provisions will continue in full force and effect.
No Waiver: No waiver of any term or condition of these Terms by Hormn shall be deemed a further or continuing waiver of that term or any other term. Any failure by Hormn to assert a right or provision under these Terms is not a waiver of our right to do so later.
Assignment: Hormn may assign or transfer our rights and obligations under these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets, or by operation of law. We will notify you if such a transfer occurs. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
Relationship: Nothing in these Terms is intended to create any joint venture, partnership, employment, or agency relationship between you and Hormn. In particular, the Practitioners and Pharmacies are independent professionals and not employees or agents of Hormn, and nothing in these Terms should be construed to the contrary.
